Project-related data is retained for 5 years after contract completion to comply with French tax regulations. Contact form submissions are retained for 2 years. Marketing consent records are maintained indefinitely until withdrawal.

REFUND_PROTOCOL

1. Project Milestones
Web design projects are delivered in defined milestones. Payments are tied to completed milestones as outlined in the project agreement. Refund eligibility depends on the stage of project completion.
2. Pre-Development Cancellation
If cancellation occurs before development begins (within 7 days of contract signing), a full refund minus administrative fees (10% of deposit) will be issued within 14 business days.
3. Mid-Project Cancellation
For cancellations after development has begun, refunds are calculated based on completed work. Milestones already delivered and approved are non-refundable. Work-in-progress will be delivered as-is, and any advance payments for future milestones will be refunded proportionally.
4. Post-Delivery Refunds
After final delivery and client approval, services are considered complete. A 14-day review period is provided during which significant defects or deviations from the agreed scope will be corrected at no additional cost.
5. Refund Process
Refund requests must be submitted in writing to [email protected] within 30 days of the payment date. Refunds are processed via the original payment method within 14 business days of approval.
6. Non-Refundable Items
The following are non-refundable: third-party licenses purchased on behalf of the client, domain registration fees, hosting setup fees, and work completed and approved under signed-off milestones.
7. Dispute Resolution
Refund disputes will be handled in good faith through direct communication. Unresolved disputes may be submitted to mediation through the French Mediation Service for Digital Economy (FMED). This policy complies with EU consumer protection directives.

1. Service Scope
smartcanvaspeak provides web design, development, and digital branding services. Each project scope, deliverables, timeline, and pricing are defined in a separate project agreement signed by both parties. These terms apply to all services unless explicitly superseded by the project agreement.
2. Client Obligations
Clients must: provide accurate project requirements and brand assets, respond to communications within 5 business days, review and approve deliverables within the agreed review periods, and make payments according to the agreed schedule.
3. Intellectual Property
Upon full payment, all final deliverables and associated intellectual property rights transfer to the client. smartcanvaspeak retains the right to display completed work in portfolio and marketing materials unless explicitly prohibited in writing. Source code for custom developments is delivered to the client upon project completion.
4. Payment Terms
Invoices are payable within 14 days of issue unless otherwise agreed. Late payments incur a 1.5% monthly interest rate. Work may be paused if payment is more than 30 days overdue. All prices are in Euros (€) and exclude applicable VAT.
5. Project Timeline
Estimated timelines begin upon receipt of all required client materials and initial payment. Delays in client feedback or material delivery will extend the timeline proportionally. smartcanvaspeak will notify clients of any anticipated delays within 48 hours of awareness.
6. Revisions
Standard projects include up to 3 rounds of revisions per deliverable. Additional revisions beyond this scope are billed at €75/hour. Revision requests must be consolidated and submitted together to ensure efficient processing.
7. Limitation of Liability
smartcanvaspeak's total liability shall not exceed the total fees paid under the project agreement. We are not liable for indirect damages, lost profits, or business interruption. We recommend clients maintain independent backups of all content and data.
8. Confidentiality
Both parties agree to maintain confidentiality of proprietary information shared during the project. This obligation survives termination of the agreement for a period of 3 years.
9. Governing Law
These terms are governed by French law. Any disputes shall be resolved before the competent courts of Strasbourg, France. The parties agree to attempt amicable resolution before initiating legal proceedings.
10. Modifications
smartcanvaspeak reserves the right to modify these terms with 30 days' written notice. Continued use of our services after the notice period constitutes acceptance of the modified terms.
